PUBLIC NOTICE PUBLIC HEARING AND OF INTENTION TO ENACT PROPOSED ORDINANCE TAKE NOTICE that the Board of Supervisors of Barrett Township will hold a public hearing on Wednesday, August 12, 2020 at 5:30 p.m. to consider adoption of an ordinance that would amend certain provisions of the Zoning Ordinance (Ordinance 175). At the time of the public hearing, the Supervisors will listen to comments by members of the public concerning the proposed ordinance. If substantial amendments are not offered to the draft of the proposed ordinance, the Supervisors intend to consider enactment of the proposed ordinance immediately after the public hearing. The proposed ordinance is entitled: AN ORDINANCE OF THE TOWNSHIP OF BARRETT, MONROE COUNTY, PENNSYLVANIA, AMENDING CERTAIN PROVISIONS OF THE BARRETT TOWNSHIP ZONING ORDINANCE (ORDINANCE 175).

The following is a brief summary of all of the provisions of the proposed ordinance:

 

Section 1 amends Article 2 (Definitions) to add and/or change definitions of certain terms used in the Zoning Ordinance. Section 2 amends Article 4 (Conservation District C) by including short term rentals, accessory buildings, and accessory contractor or trade as uses permitted by right, and including agricultural entertainment uses as permitted by conditional approval in the Conservation District. Section 3 amends Article 5 (Residential District - R) by including short term rentals, accessory structures, and accessory contractor or trade as uses permitted by right, and including private club or community center and agricultural entertainment uses and by removing nursing home and/or assisted living facility and accessory buildings as uses permitted by conditional approval in the Residential District. Section 4 amends Article 6 (Mixed Use Village District MU-V) by including places of worship, athletic facilities, private clubs or community centers child care facilities, repair shops, motels, hotels and inns, commercial recreation and entertainment and short term rentals as uses permitted by right and by removing those uses and including agricultural entertainment uses as permitted by conditional approval in the Mixed Use-Village District. Section 5 amends Article 7 (Commercial Resort/Hotel District - CRH) by including commercial recreation and entertainment and short term rentals as uses permitted by right, and by removing commercial recreation and entertainment and including agricultural entertainment uses as uses permitted by conditional approval in the Commercial Resort/Hotel District, and by changing the minimum front, side and rear yard dimensions in that zoning district. Section 6 amends Article 8 (Light Industrial District LI) by including single-family detached, townhouses, multi-family dwellings, service businesses, eating places, eating places with drive in/through, motels, hotels and inns, commercial recreation and entertainment, short term rentals, manufacturing, and equipment storage yards as uses permitted by right, and by removing single-family detached, manufacturing and equipment storage yards and by including nursing homes and/or assisted living facilities and agricultural entertainment uses as uses permitted by conditional approval in the Light Industrial District. Section 7 amends Article 9 (Industrial District I) by including single-family detached, townhouses, multi-family dwellings, short term rentals, equipment storage yards, truck terminals, food processing, laundry, dry-cleaning and dyeing plants as uses permitted by right, and by removing single-family detached, equipment storage yards, truck terminals, food processing, laundry, dry-cleaning and dyeing plants and by including agricultural entertainment uses as uses permitted by conditional approval in the Industrial District. Section 8 amends Article 14 (Nonconformities) by replacing that Article, including Sections 1401 through 1401, in its entirety. Section 9 amends Article 15 (Administration) by replacing Sections 1501 (Enforcement) and Section 1505, subparagraph B (Public Notice), in their entirety. Section 10 amends Appendix A (Table of Use Regulations) by updating the permitted and conditional uses in each zoning district as heretofore changed by this ordinance. Section 11 and Section 12, respectively, contain repealer and validity provisions. Section 13 provides that the proposed ordinance shall be effective five days after the date of its enactment. Depending on guidance from health authorities, the public hearing will either be conducted in-person or by remote technology. If an in-person meeting is appropriate, it will occur at the Barrett Township Municipal Building, located at 993 Route 390, Cresco, PA 18326. If the meeting will be conducted by remote technology, call-in information for public participation will be available by calling the Township at the number below. A copy of the proposed ordinance has been supplied to the Pocono Record and to the Monroe County Law Library.
